Dispute resolution

Posse Herrera Ruiz is a full-service firm with a robust dispute resolution practice. The team of 18 legal professionals have acted as local counsel in disputes before local and international courts, government agencies, and arbitration panels.

Founding partner Daniel Posse chairs the disputes practice group. He represents Accion Fiduciaria, a local fiduciary company, in a claim against its legal representative and administrator of the fiduciary, arising from its failure to show duty of care and duty of loyalty in its actions. One of Benchmark Lat-Am’s Top 25 Women in Litigation is Carolina Posada, who is recognized for her work in arbitration matters, as well as tort, contractual liability, and insurance and reinsurance disputes. Posada represented Huawei, an electronics company in an arbitration concerning an alleged unjustified ending of a contract and its lack of fulfillment. She additionally represented Blau Pharmaceutical in proceedings brought against them by minority shareholders concerning alleged rights infringement.

Maria Lucia Posada is active in the dispute resolution and public law space. She routinely represents clients in administrative and civil disputes. She represented Cerro Matoso in a $400 million damages claim relating to alleged harm caused against indigenous communities. She also assisted the client in arbitration proceedings that arose from the termination of a maintenance agreement. Pablo Sierra is active in collection actions, constitutional actions, regulation and damage estimation, contractual liability, and tort disputes. Sierra represents Bancolombia in 29 claims concerning unpaid dues. He also defended CCX, a coal mining operator, in a case brought against them from a company who sought payments. Sierra was able to negotiate $18 million less than the initial $27 million claim. The remaining amount pending is still under review.
