Robert J. Giuffra, Jr. is regularly recognized as one of the leading trial lawyers in the United States, handling clients’ most important and complex matters.
A Fellow of the American College of Trial Lawyers, Bob has advised on many of the most high-stakes litigation matters of the past two decades. In one year alone, he handled five important trials. These cases included serving as lead counsel for Dish and EchoStar in the closely-watched, multi-week trial in federal bankruptcy court and representing Enbridge in one of the biggest jury trials in recent Texas history.
He is currently National Coordinating Counsel for Volkswagen in its recent diesel-related matters and represents Fiat in its emissions issues. He has defended leading financial institutions in litigation and government investigations arising out of the financial crisis, the bankruptcy of Enron and the accounting fraud at HealthSouth Corporation.
His work for clients has set precedents in many areas, including Volkswagen’s landmark settlement resolving emissions-related matters, the first deferred prosecution agreement from the U.S. Securities and Exchange Commission and a number of precedent-setting decisions before federal appellate courts, including limiting the extraterritorial reach of U.S. federal securities laws.
Bob has served in all three branches of the U.S. Government. He was a law clerk to Chief Justice William Rehnquist of the U.S. Supreme Court and to Judge Ralph Winter of the U.S. Court of Appeals for the Second Circuit. In addition to his federal judicial clerkships, he was the Chief Counsel of the U.S. Senate Committee on Banking, Housing and Urban Affairs from 1995 to 1996. He was a primary drafter of the Private Securities Litigation Reform Act of 1995. He also served in the White House.
He has been appointed by governors of both political parties to serve in New York State Government. From 2007 to 2009, he was one of 13 members of the New York State Commission on Public Integrity. From 1998 to 2007, he served as one of the five Commissioners of the New York State Ethics Commission. While at S&C, he also was a Special Assistant District Attorney, County of New York.
Bob is a leader of the Bar. He served as President of The Federal Bar Council. In 2017, Chief Justice John Roberts appointed him to serve on the Standing Committee on Rules of Practice and Procedure of the U.S. Courts. He has served on the NYS-Federal Judicial Council, the New York State Commercial Division Advisory Council, the Magistrate Judge Selection Panel for the SDNY, the New York County Commercial Division Advisory Committee, the New York Commission on Attorney Discipline, New York’s Permanent Commission on Access to Justice and the Board of Editors of New York Law Journal. He is also the Chairman of the Board of Advisors of the Yale Law School Center for the Study of Corporate Law and a Vice President of the Supreme Court Historical Society.
Bob is a member of Sullivan & Cromwell’s Management Committee, with responsibility for the Firm’s Litigation practice, and is the head of the Securities Litigation practice.
