Scott Gilbert counsels his clients during critical moments of the employment relationship, both in the form of day-to-day counseling and defending employment litigation matters. Whether a client needs to create a strategy related to a reduction in force, or help navigating the interactive process under the Americans with Disabilities Act, Scott offers practical advice to help clients identify and evaluate risk factors in order to minimize liability while accomplishing their business goals.  Unfortunately, not all disputes can be avoided, and Scott also advises clients in all facets of employment litigation, from claims before various administrative agencies through litigation in federal and state courts. Scott also represents employers in traditional labor disputes before the National Labor Relations Board, employee dismissal hearings and arbitrations, and wage and hour issues before state and federal Departments of Labor. Scott regularly advises clients on matters related to restrictive covenants from both the enforcement and defensive perspectives, and has successfully enforced covenants in jurisdictions around the country.  Scott also works with his clients to develop protocols to protect their confidential information and talent from landing with competitors. Regardless of what place in the employment spectrum Scott is involved, his efforts are always influenced by understanding the unique nature of the client’s business and what they need to accomplish in relation to each engagement.  He understands that legal advice cannot exist in a vacuum, but must instead be pragmatic and tailored to the specific issue at hand.  Ultimately, Scott’s goal is to help the client achieve its business objective while effectively managing employment-related risks.
