    “照付不议”条款起初应用于国际天然气销售市场，“照付不议”条款的诞生和应用有其独特的商业背景：天然气产品交易中，供应方为开采、存储、运输天然气，需要付出设备、人工以及施工等成本，为向特定采购方供气，供应方往往还需要协助采购方安装储罐、管路等多种设施。因此，天然气采购合同中，供应方除了供应天然气货品外，还承担了各类前期投资，导致供应成本高昂。由于天然气是根据采购方的需求按期供应，而非一次性交易，故供应方为收回成本、取得利润、保护自身资金链，必须确保采购方长期、稳定地用气。
