J. Wesley Earnhardt is a partner in Cravath's Litigation Department. He has a broad practice with significant experience in the areas of securities, antitrust, intellectual property, contracts, business torts and media law. Mr. Earnhardt's clients have included Atlas Air, Boulder Brands, Dooney & Bourke, ESPN, JPMorgan Chase, Qualcomm, Spirit AeroSystems, Time Warner, The Walt Disney Company and Xerox. He also serves as the Firm's partner in charge of data analytics and e-discovery.
Mr. Earnhardt currently represents Qualcomm in various matters, including antitrust and patent suits filed by Apple and the FTC, and breach of contract suits filed by Qualcomm against four Apple contract manufacturers. He recently won summary judgment for Spirit AeroSystems in a breach of contract lawsuit brought by The Boeing Company, seeking indemnification from Spirit for damages and expenses that Boeing incurred as a result of two proceedings initiated by former Boeing employees.
His other notable representations include winning the dismissal of a class action suit against Dooney & Bourke alleging false advertising practices in violation of state consumer protection laws; winning a dismissal for ABC and ESPN of a putative class action lawsuit seeking pay for NCAA student athletes (affirmed on appeal); and winning a dismissal upon summary judgment for Xerox in a $2 billion securities class action in Connecticut federal court arising from its 1998 restructuring (affirmed on appeal).
Mr. Earnhardt devotes substantial time to pro bono service, including by serving as Co- Chair of the Board of Directors of The Adams Street Foundation, a nonprofit supporting the Urban Assembly School for Law and Justice. He is also a board member of The Fund for Modern Courts, a nonprofit organization committed to improving the judicial system in New York.
Mr. Earnhardt has been repeatedly recognized for his litigation work by numerous professional publications, including The American Lawyer, Benchmark Litigation, The Legal 500 United States and Super Lawyers. He was named a Rising Star by New York Law Journal (2016) and among the nation's top securities and class action litigators under 40 by Law360 (2014, 2016).
Mr. Earnhardt received a B.A. in Economics with distinction from the University of North Carolina at Chapel Hill in 2000 and a J.D. with high honors from the University of North Carolina School of Law in 2004. He joined Cravath in 2004 and was elected partner in 2011.
