Benjamin Heidlage represents both individuals and corporations in contract, securities, and antitrust disputes in state and federal courts and arbitral tribunals. Most recently, Ben led the case team on a high-dollar dispute between HSG’s client, PetSmart, and lenders challenging certain liability management transactions under a $4.2 billion credit agreement. He is also heavily involved in the firm’s representation of banks as trustees or securities administrators in various RMBS “putback” matters, each involving hundreds of millions of dollars, including as a member of the team representing the trustees as lead trial counsel in the Lehman bankruptcy resulting in a favourable $2.4 billion award. He is a member of the team representing a MacAndrews & Forbes company in a case involving a billion-dollar antitrust claim against News Corp. and its subsidiaries, and was also a member of the team involved in a New York-based arbitration involving a commercial dispute between Japanese and Mexican parties.
He has represented clients in the financial and technology sectors in antitrust matters pending in foreign and domestic tribunals. He has also represented a client at trial and on appeal in a case involving one of the largest CERCLA sites in the country. Ben has played a significant role in multiple shareholder disputes brought in connection with mergers and acquisitions, litigating issues including the fiduciary duties of company directors and officers and required disclosures.
Ben serves as a co-chair of the Board of Directors of Atlas: DIY, which offers legal resources, educational programming, and social services to undocumented immigrant youth in New York City, and has dedicated significant pro bono time to immigration matters.
Ben was promoted to partner in January 2018 and has been named to Benchmark Litigation’s Under 40 Hot List since 2018. Before joining Holwell Shuster & Goldberg in 2014, he was an associate at Cravath, Swaine & Moore and clerked for Judge Patrick Higginbotham of the U.S. Court of Appeals for the Fifth Circuit. He is a past recipient of the New York University Law Review Alumni Association Award.
