Demian Ordway represents clients in an array of complex commercial matters. He is currently representing Visa in In re Payment Card Interchange Fee and Merchant Discount Antitrust Litigation, a multidistrict class action litigation pending in the Eastern District of New York in which virtually every merchant in the country has brought antitrust claims against Visa and Mastercard. He also represents Visa in a suit brought by Kroger, the nation’s largest grocer, which challenges the terms under which debit cards are used at Kroger’s stores. In a similar suit brought by Walmart, the world’s largest retailer, Demian helped Visa obtain a favorable settlement. Demian’s other antitrust work includes advising a major German financial institution on potential antitrust claims stemming from the LIBOR scandal, and counseling companies on the scope of non-compete clauses.
Outside of antitrust, Demian has represented multiple bank trustees as plaintiffs seeking to determine responsibility for billions of dollars in losses in residential mortgage-backed securities, defended an asset manager from claims alleging hundreds of millions of dollars in losses due to failed collateralized debt obligations, and defended a major financial institution against copyright infringement claims alleging, again, hundreds of millions of dollars in damages.
Demian has also given back to the community, handling pro bono matters on issues of personal importance to him, representing clients such as the Center for Reproductive Rights and Brennan Center for Justice. As Holwell Shuster & Goldberg’s chief technology officer, Demian handles all decisions regarding the firm’s IT systems, including technology purchases, staffing, and vendor negotiations. He has been named to Benchmark Litigation’s 40 & Under Hot List since 2017.
Prior to joining HSG, Demian was a litigation associate at Paul, Weiss, Rifkind, Wharton & Garrison LLP and clerked for Judge Richard J. Holwell in the Southern District of New York and Judge M. Blane Michael in the Fourth Circuit.
