  • In re Teva Securities Litigation: Evan represented Ontario Teachers’ Pension Plan Board and Anchorage Police and Fire Retirement System in a securities class action against Teva Pharmaceuticals Industries Ltd., the world’s largest generic drug manufacturer, and achieved a historic $420 million class settlement.
    The litigation—which lasted over five years—arose from Teva’s scheme to increase drug prices by over 1,000% while misrepresenting the true drivers of Teva’s financial performance. Evan led the technical aspects of the case and secured the full certification of the class and the denial of defendants’ Rule 23(f) petition.At the merits stage, Evan deposed 10 fact witnesses and led the class’s expert work and Daubert motions.Ultimately, the action settled on the eve of summary judgment. The $420 million settlement is among the largest recent securities settlements in the Second Circuit. In approving the settlement, Judge Underhill stated that “[t]he quality of the representation was excellent... and I think it was done exceptionally well.”

  • In re Talis Biomedical Securities Litigation: Evan represented lead plaintiff Martin Dugan in this securities class action arising from a failed COVID-19 test, culminating in a $32.5 million class settlement.Evan led nearly three years of intense litigation, defeating defendants’ motion to dismiss, securing class certification over intense opposition, pursuing extensive fact and expert discovery, and navigating complex scientific, regulatory, and bankruptcy issues. The settlement represents up to 72% of realistically recoverable damages, which the Court praised as an “excellent” result.

  • In re ICON plc Securities Litigation: Evan represents Police and Fire Retirement System of the City of Detroit, The Trustees of the Local 464A United Food & Commercial Workers’ Union Welfare Service Benefit Fund and the Trustees of the Welfare and Pension Funds of Local 464A-Pension Fund, and Macomb County Retiree Health Care Fund in this ongoing securities class action. The action alleges that ICON, a large Clinical Research Organization, misrepresented its business performance and engaged in premature revenue recognition in violation of U.S. Generally Accepted Accounting Principles.Evan has applied his financial and accounting expertise to develop detailed allegations of accounting fraud that ultimately led ICON to restate its financials due to “material errors.”
