Jeff Warshafsky is a versatile commercial litigator and strategic advisor who specializes in consumer class actions, sports litigation, advertising and marketing disputes, trademark litigation, and other complex disputes. With over 13 years of experience, Jeff has successfully managed dozens of class actions and multi-district litigation for multinational companies across diverse sectors, including large consumer class actions.
Jeff frequently represents clients in competitor-versus-competitor advertising disputes, including in Lanham Act cases and advertising self-regulation disputes before the National Advertising Division. He also counsels companies on advertising substantiation issues, with an emphasis on complex scientific testing, such as clinical trials and sensory testing.
Jeff has worked with the Firm’s most prominent clients such as Church & Dwight, National Football League, Women’s Tennis Association, Bausch Health, Grifols S.A., Live Nation, Ralph Lauren Corporation, S.C. Johnson, Welch’s, and other household names. With a background in Life Sciences, clients value his deep understanding of the science behind product testing, clinical studies, and other complex issues, enabling him to provide insightful advice that extends beyond his legal expertise.
In addition to his legal prowess, Jeff is dedicated to mentoring women and diverse associates, demonstrating his commitment to fostering diversity and inclusion within the legal profession. - Representation of the National Football League and its 32 Clubs in antitrust class actions alleging a conspiracy with Fanatics to monopolize the market for online sales of NFL-branded merchandise.
- Lead counsel for Live Nation and Madonna in class actions alleging false advertising in connection with alleged late starts for shows in Madonna’s Celebration Tour.
- Representation of SoClean in a multidistrict litigation, which includes a major Lanham Act case as the plaintiff against Philips entities related to the recall of millions of CPAP and respiratory care devices, and the defense of over 40 consumer class actions against SoClean alleging false advertising.
- Defense of the legendary Canadian rock band, The Guess Who, in a false advertising lawsuit filed by two former members of the band. Plaintiffs allege violations of the Lanham Act and other laws and sought over $20 million in damages.
