Biography

Josh Bruckerhoff is a partner at Reid Collins & Tsai. He appears in federal and state courts across the country representing bankruptcy trustees, offshore liquidators, and companies in litigation against directors and officers, law firms, banks, auditors, and recipients of fraudulent transfers.

Josh is known for finding innovative solutions to complex cases. For instance, Josh developed the arguments that resulted in a landmark victory in the Seventh Circuit concerning the scope of section 546(e) of the Bankruptcy Code. The U.S. Supreme Court, in Merit Management Group v. FTI Consulting, affirmed the Seventh Circuit’s ruling, opening new avenues of recovery for bankruptcy trustees across the country.

Josh has broad experience handling cross-border matters, having worked on cases such as Bear Stearns, Stanford International Bank, ICP Strategic Credit Income Fund, and AJW Master Fund. He has pursued both U.S. and foreign-law claims on behalf of liquidators in the context of Chapter 15 proceedings.

Josh also devotes a significant portion of his practice to bringing legal-malpractice claims. He has handled an array of such claims, including matters where the law firm was alleged to have: failed to file claims within the statute of limitations, negligently drafted multimillion-dollar loan documents, failed to report fraud to a company’s independent directors, overbilled its client in connection with an internal investigation, and provided erroneous advice on federal and state securities laws.

Josh is widely recognized for his professional achievements. Among other industry accolades, leading legal periodical Lawdragon has recognized him as one of the 500 Leading Lawyers in America and one of the 500 Leading Global Restructuring & Insolvency Lawyers. The National Law Journal named Josh a Rising Star of the Plaintiffs’ Bar in 2021 and Benchmark named him to its 40 & Under Hot List in 2020 & 2021

Recent matter/case highlights
  • Representation of shareholders of JUUL in a derivative action against JUUL’s directors and major stockholders. The matter is ongoing in the Delaware Court of Chancery.

  • Representation of a Fortune 100 company in a legal malpractice claim seeking more than $500 million in damages. The confidential matter is ongoing.

  • Representation of the Litigation Trust for Alta Mesa Resources, an oil and gas exploration and production company that filed for bankruptcy, in claims against the company’s former officers for breach of fiduciary duty. The Litigation Trust sought hundreds of millions of dollars in damages. The case settled following briefing on a motion for summary judgment.

  • Representation of the Litigation Trust for Lyondell Chemical Company in a $300 million legal malpractice claim. The case settled on a confidential basis after a favorable ruling denying the law firm’s motion to dismiss.
     
  • Representation of the Litigation Trust for Limetree Bay Refinery in several claims to recover tens of millions of dollars in losses relating to a massive fire at the refinery.
