Recent matter/case highlights
  • Counsel to the Pride Group in their CCAA proceedings, which have been recognized under Chapter 15 of the US Bankruptcy Code. The Pride Group is a trucking and logistics conglomerate that operates across Canada and the United States and with secured liabilities in excess of $1.6 billion, involving over 40 lending institutions. The complexity and size of this matter in Canada is unprecedented in terms of the range and number of loan facilities, business lines and lenders.

  • Counsel to The Boeing Company in the CCAA proceedings of Lynx Air and the unique negotiation of the potential purchase of the rights to purchase future Boeing aircraft.

  • Counsel to Carriage Hills and Carriage Ridge, not-for-profit organizations that operated two time-share resorts. The real property upon which the resorts were situated were owned by approximately 30,000 members who each owned a partial interest as tenants-in-common in the real property and have a perpetual obligation to pay annual membership fees. The growing number of delinquent members and increasing capital expenses caused an untenable financial situation. Because the Applicants were funded by the members, they were not insolvent and could not initially avail themselves of either the BIA or CCAA – Canada’s insolvency legislation. On behalf of the Applicants, we obtained a unique order appointing an Administrator to determine whether the resorts were financially viable. Once it was determined that the were not viable, the assets were sold for $60 million and the Receiver developed a unique claims process to distribute the funds to the 30,000 members. The claims portal contained over 5 million points of data, and was also used to effect payments to members.

  • Counsel to the Trustee in Bankruptcy of Aiden Pleterski, a 23 year old self-proclaimed crypto king who established a Ponzi scheme to defraud investors of at least $40 million to support his lavish lifestyle.
