Rebecca J. Schindel focuses her practice on complex litigation, particularly in the areas of antitrust, securities and general commercial disputes. She has represented a variety of clients, including American Express, the Blue Cross Blue Shield Association and several member plans, First Solar and Merck.
Ms. Schindel is from Pound Ridge, New York. She received a B.A. with honors in Public Policy from Stanford University in 2010 and a J.D. magna cum laude from Harvard Law School in 2016. At Harvard, she was a senior article editor of the Law & Policy Review, a line editor of the International Law Journal, a teaching assistant for Legal Research and Writing and a research assistant to Climenko Fellow Maggie Gardner.
Ms. Schindel joined Cravath in 2016. After serving as a law clerk to Hon. Katherine B. Forrest of the U.S. District Court for the Southern District of New York and to Hon. Karen Nelson Moore of the U.S. Court of Appeals for the Sixth Circuit, she rejoined Cravath in 2018 and was elected a partner in 2025.
Representing the Blue Cross Blue Shield Association (“BCBSA”) and more than a dozen member plans in consolidated multidistrict antitrust class action litigation—one of the largest class actions in the country—alleging that the Association and its members have used the Association’s agreements to fix prices and limit competition. Ms. Schindel also represents BCBSA and various member plans in related opt-out litigation across the country brought by large self‑funded subscribers and providers.
Secured a major trial victory for American Express (“Amex”) in class action litigation brought in New York federal court by classes of debit card and non‑reward credit card users in multiple states alleging that Amex’s non‑discrimination provisions inflated prices paid for goods and services sold by merchants across the country. Following a three‑week trial, the jury unanimously found that Amex’s non‑discrimination provisions do not unreasonably restrain trade—an important win that protects Amex’s business model.
Represented American Express (“Amex”) in an antitrust class action lawsuit in New York federal court brought by merchants alleging that Amex and numerous other credit and charge card issuers conspired to shift certain costs of fraudulent charges from the card issuers to merchants by the implementation of standards replacing swipe cards with chip cards. The parties ultimately reached a settlement to resolve the action.
Represented Florida Blue in winning the dismissal of antitrust litigation filed by competitor Oscar Insurance alleging that Florida Blue’s exclusive agency relationships violated the Sherman Act.
- Represented First Solar in a securities class action in Arizona federal court alleging that First Solar and several of its officers and executives concealed manufacturing issues with its solar modules and committed accounting violations, which settled on favorable terms the night before jury selection.
