Zhen Zhao

Zhen Zhao is a senior partner of Jincheng Tongda & Neal Law Firm, as well as an arbitrator in several arbitration commissions. Zhen Zhao's practice focuses on litigation and arbitration, international commercial arbitration, compliance and government regulation. Zhen Zhao had worked in a Beijing Intermediate People's Court for a long time where he served as the judge of Civil and Commercial division. During this period, he adjudicated and participated in almost 1000 cases. Zhen Zhao has represented many domestic and international litigation cases with significant influence, such as the Share disputes between Vanke Co., Ltd and Baoneng Group ( Vanke-Baoneng Spat), the first consumer public interest dispute in China filed by China Consumers Association, etc. Zhen Zhao has rich experience in dealing with significant, knotty and sophisticated commercial disputes.

• Represented a U.S. Nasdaq-Listed company against Alpha Advantage Global Limited and Dynamic Fame Limited in the case of liability for prejudice to the interests of shareholders
  The plaintiff and defendant in this case are registered in the British Virgin Islands and the British Cayman Islands respectively. Due to the significant influence of this case, the Supreme People’s Court ruled that the case would be judged by the Supreme People’s Court in the first instance. The presiding judge is Xiaoli Gao, a judge of the International Commercial Court and the United Nations Appeals Tribunal. A total of five Supreme People’s Court judges formed a collegiate bench.
• Represented “Qinling Villa Project”, won the case during retrial by the Supreme People’s Court
  In the case that other lawyers lost the first and second instance procedures, Zhen Zhao applied for retrial on behalf of his client, and finally urged the Supreme People’s Court to change the original sentence. Zhen Zhao took the change of circumstances as a breakthrough agency idea in this case, which marked the first case to apply the judgment of change of circumstances since the promulgation of the Civil Code.
• Represented Lunan Pharmaceutical Group Co., Ltd. in shareholders control dispute and board control dispute
  The amount involves in this case is RMB hundreds 100 million. The disputes consist of 7 domestic and foreign lawsuits heard in the Supreme People's Court, Shandong High People’s Court, the British Virgin Islands (BVI) High Court, etc. Among these 7 lawsuits, 5 lawsuits were represented by Zhen Zhao, 2 lawsuits were collaborated by Zhen Zhao and Queen's Counsel from Appleby law firm.
• Represented a Series of Cases Regarding VAM Agreement Disputes, the amount involves in this case is RMB 320 million
  Whereas the request of other investors in previous cases were not supported, in September 2021, the CIETAC ruled in support of the request made by the applicant (the investor) represented by Zhen Zhao that the respondent pay RMB 320 million for share repurchase. At the enforcement level, Zhen Zhao worked with Hong Kong lawyers to facilitate the High Court of Hong Kong ordered that the applicant to enforce the CIETAC Award.
• Represented a U.S. capital company against a Chinese company and a Hong Kong Company in a derivative action of arbitration dispute which was arbitrated by AAA (American Arbitration Association)
  The amount involves in this case is RMB 560 million. The disputes consist of 7 domestic and foreign lawsuits heard in the Mainland China, Hong Kong, China and America.
