Biography
Jennifer H. Roscetti is a partner at Finnegan, a current member of the firm’s Management Committee, and immediate past co-leader of the firm’s Litigation and Trial Section. She focuses on patent litigation before U.S. district courts, the U.S. International Trade Commission, and the U.S. Court of Appeals for the Federal Circuit. Her practice emphasizes pharmaceuticals and other chemical technologies.
Jennifer has extensive experience representing pharmaceutical patent holders in Abbreviated New Drug Application (ANDA) litigation involving blockbuster products. As lead counsel, she has handled every phase of federal district court litigation, from pleadings through fact and expert discovery, motions, claim construction, and trial. She also advises multinational clients on infringement, validity, enforceability, and U.S. litigation strategy, often coordinating complex patent matters with global legal, scientific, and business teams.
Jennifer was recognized by LMG Life Sciences as Hatch-Waxman Litigator of the Year, Branded, in 2024. Her representations of branded pharmaceutical companies, including AbbVie and Otsuka, contributed to Finnegan being named Hatch-Waxman Litigation Firm of the Year – Branded at the 2025 LMG Life Sciences Awards.
Jennifer brings an engineering and scientific background to her patent practice. Before practicing law, she worked for ExxonMobil Chemical Company and E.I. du Pont de Nemours and Company and conducted anti-cancer drug research at the University of Kentucky College of Pharmacy.
Jennifer also regularly lectures in the United States and internationally on developments affecting the pharmaceutical and biotechnology industries and serves as an adjunct professor at Howard University School of Law. She was shortlisted for Life Sciences Lawyer of the Year at the 2023 Women in Business Law Awards. She previously led Finnegan’s chemical and metallurgical practice group and served on the firm’s coordinating committee.

- AbbVie / Neurocrine – ORILISSA® ANDA Litigation
Serves as lead counsel representing AbbVie and Neurocrine in multi-defendant Hatch-Waxman litigation concerning ORILISSA® (elagolix sodium). Her leadership has included trial strategy and successfully opposing generic defendants’ efforts to delay trial. Following the 2025 trial, the parties agreed to await Judge Hall’s decision, which remains pending. - BIAL / Sunovion – APTIOM® ANDA Litigation
Served as lead trial counsel representing BIAL and Sunovion in Hatch-Waxman litigation in the District of Delaware involving APTIOM®, a treatment for partial-onset seizures. Led the trial team through a three-day bench trial against a generic challenger, resulting in a favorable judgment upholding the validity of three patents covering novel once-daily methods of treatment. - Pronova Biopharma – LOVAZA® Hatch-Waxman Litigation
Played a leading role representing Pronova Biopharma Norge in Hatch-Waxman litigation concerning multiple ANDAs seeking approval for generic versions of LOVAZA®. The litigation resulted in a judgment of infringement, validity, and enforceability in Pronova’s favor, followed by proceedings before the U.S. Court of Appeals for the Federal Circuit. - Grünenthal – NUCYNTA® / NUCYNTA® ER Hatch-Waxman Litigation
Represented Grünenthal in multiple Hatch-Waxman actions involving NUCYNTA® and NUCYNTA® ER and multiple generic challengers. The litigation resulted in the district court enjoining defendants from marketing generic versions until patent expiration, with the broader representation also encompassing related PTAB proceedings and coordination with U.S. prosecution and European patent proceedings. - Rocket Pharmaceuticals – Trade Secret Litigation
Served as lead litigation counsel representing Rocket Pharmaceuticals in complex federal trade-secret and breach-of-contract litigation involving treatments for genetic disorders. The litigation concluded in a settlement resolving the dispute.
