Recent matter/case highlights
- Secured the dismissal with prejudice of a lawsuit against Amazon.com brought by Select Research, Ltd., accusing Amazon of misappropriation of trade secrets, breach of contract, and patent infringement.
- Obtained a complete defense verdict for a major insurer in a hard-fought, bifurcated arbitration against a government hospital. The hospital sought over $50 million in damages and penalties, alleging that the insurer breached the parties’ contract and violated the False Claims Act by knowingly avoiding payment. Persuaded the arbitrator to rule for the client on all issues and claims.
- Secured a sweeping victory for Joe Kiani, Founder and CEO of Masimo Corp., a global technology company, in a highly publicized activist shareholder suit challenging Kiani’s employment agreement. Plaintiffs asserted claims for breach of fiduciary duty and sought to invalidate key provisions of the agreement, allegedly worth more than $1 billion. With trial approaching, plaintiffs voluntarily dismissed all claims.
- Obtained a complete defense verdict for PricewaterhouseCoopers in a high-profile, closely watched federal trial brought by former employee and SEC whistleblower Mauro Botta. Earlier in the litigation, secured dismissal of all claims against seven individual partners at the pleading stage.
- Defended Valeant Pharmaceuticals in a multibillion-dollar securities class action alleging violations of insider trading and control person liability statutes. After argument on summary judgment motions, obtained favorable settlements of all claims.
