Dispute resolution

A spinoff from the demerger of Chooi & Company + Cheang & Ariff, Chooi & Company’s dispute resolution department is best known for its strength in corporate and commercial litigation, particularly in handling boardroom takeovers and shareholder disputes within both public listed and private companies. Additionally, the department handles a diverse range of legal matters encompassing land and property, contracts, torts, commercial fraud, trusts and estates, construction and building, insolvency and banking, as well as other civil disputes.

Seasoned dispute partners Sau Foo (Christopher) Leong, Ira Biswas, Tuck Sun Lim, Pei Ying (Janet) Chai and Yeong Hui Yap helm the firm’s dispute resolution practice.

In a notable commercial and transactions case, the firm provided legal counsel to a KPMG partner. Remarkably, the firm successfully obtained leave for judicial review while also overcoming an application made by the council of the Malaysian Institute of Accountants to strike out or remove itself from the judicial review application filed by the applicant. This case holds significant importance due to its exploration of a novel question: whether information prohibited from disclosure under the Financial Services Act 2013 and Islamic Financial Services Act 2013 can be disclosed for the purpose of investigation by a body established under the Accountants Act 1967. Notably, both Acts lack exceptions to the prohibition for such disclosure or purpose.

The rest of the clients the firm has advised remain confidential.
