Dispute resolution

Renowned for its banking and finance prowess, it’s no surprise that one of Jerome Merchant + Partners’ core contentious strengths is in bankruptcy matters. The team has a deep bench of expertise and experience in the country’s insolvency laws. It works with investors and lenders in restructuring of their debt exposures, enforces their rights under the IBC, advises sponsors on actions brought against them, and challenges proceedings or resolution plans that have been prejudicial to such sponsors. In addition to this, the team is well versed in commercial litigation matters, providing clients with pre-litigation advice, negotiation capabilities, and effective use of court and arbitral processes. The team is experienced in general corporate, joint venture, lender, labour, contractual, IT and technology disputes, among others. A number of the firm’s confidential case submissions are related to arbitrations this year.

The main contacts for disputes matters are Murtaza Somjee and Rhia Marshall.

In a recent commercial disputes highlight, the team acted for Global Music Junction Private in litigation strategies in the proceedings before the Delhi High Court relating to a breach of a licensing agreement and specific performance of the same, seeking interim reliefs in the matter of alleged breaches.

The group’s active insolvency clients include Deutsche Bank, Horse Shoe Capital, India Infoline, Kirloskar Group, SSG Capital, Tata Motors and Videocon Group.
