The dispute centres around the construction of Light Rail Transit Line 3 stations and their connecting rails. The key issue at hand is the ownership of the right of way. Specifically, the question arises as to whether the utilisation of the right of way by a separate person or company, upon being granted a subsequent right of way by the local authority or land office, constitutes trespass. This case stands as one of the country's largest third-party claims, involving a construction project where the claimant is not a party to the original contract.
