Dispute resolution

The experienced and sizeable dispute resolution team at Zul Rafique & Partners covers civil, commercial and corporate dispute claims. Its construction and employment practices are highly regarded in the market. The firm has been growing its specialties in multiple niche areas, including securities and derivative actions, product liability, public and administrative law, media and defamation, insurance and coverage disputes, debt recovery, bankruptcy, insolvency and restructuring, shareholder disputes, land and tenancy disputes, environmental law and planning law.

Litigation head and employment specialist P Jayasingam, and senior partner and construction dispute resolution head Kuhendran Thanapalasingam are the main contacts for the practice. Keat Ching Wong is noted for her labour and employment work, while Idza Hajar Ahmad Idzam is recognised on the commercial litigation front. Employment specialist Thavaselvi Pararajasingam is another key name to note. Notably, litigation and arbitration heavyweights Wilfred Abraham and Shahul Hameed Amirudin remain at the firm as consultants.

In a seminal case, the team represented Bank Kerjasama Rakyat Malaysia, achieving a significant victory. The firm successfully recovered the amount of RM14.9 million ($3.1 million), which had been wrongfully disbursed under the influence of its former chairman, managing director, and various other individuals and entities. This payment was made in connection with the sponsorship and launch of a book titled Antara 2 Zaman Najib Tun Razak – Mendepani Cabaran Dan Menggalas Sejuta Harapan, which centered around the former prime minister of Malaysia.

Bank Muamalat Indonesia, Boustead Petroleum Marketing, PC Manufacturing Holdings and Petronas Dagangan are among clients that worked with the firm the past year.

In 2023, the firm announced several promotions, with Idza Hajar Ahmad Idzam and Thavaselvi Pararajasingam being promoted to equity partners, while Nan Muhammad Ridhwan Rosnan was elevated to a partner position. However, during the same year, the firm also experienced departures, with partner Farah Shuhadah Razali joining Rosli Dahlan Saravana Partnership and Bailey Leong Pui Yee leaving the firm.
