Joseph Reiter has obtained favorable results across a broad range of complex litigation, including health care, antitrust, trade secret, class action, False Claims Act, whistleblower retaliation, employment, patent, and tax cases. He has substantial courtroom experience that includes examining witnesses at trial and arguing appeals.


As trial counsel for Match Group, Mr. Reiter will be going head-to-head this fall against tech giant Google over its illegal monopolization of the Android app distribution and payments markets. This year, Mr. Reiter obtained dismissal with prejudice of all claims for Deloitte Consulting in a trade secret misappropriation case related to fresh food management. He also served as co-lead trial counsel for Kaiser Foundation Health Plan in a lawsuit in which HCA Healthcare, Inc., sought hundreds of millions of dollars in damages. After a two-week jury trial, and during the plaintiff’s own case in chief, he obtained a favorable settlement for Kaiser. He also prevailed on appeal for Amazon in a taxpayer lawsuit seeking to hold Amazon liable for billions of dollars in taxes and penalties. (“Amazon Tax Collection Suit Blocked By Calif. In recent years, Mr. Reiter secured a complete victory for Amazon in an arbitration trial that eBay promoted as an international racketeering and fraud conspiracy (“Amazon wins legal fight against eBay over alleged seller poaching,” CNN); won a $25 million jury verdict against Samsung, finding that Samsung had infringed all claims of all four semiconductor-related patents at issue (“Samsung Hit With $25M Semiconductor IP Verdict in EDTX,” Law360); obtained a defense verdict for PricewaterhouseCoopers in a federal whistleblower trial (“PwC Beats Whistleblower’s Retaliation Suit After Bench Trial,” Law360); and served as trial counsel for Synchrony Bank in a fraudulent inducement action that ended with a favorable settlement for our client during plaintiffs’ case in chief. 


He has also drafted, argued, and won significant motions, including obtaining summary judgment for Deloitte in a False Claims Act litigation, prevailing at summary judgment for the California Institute of Technology in another federal False Claims Act lawsuit seeking hundreds of millions of dollars for alleged defrauding of the Department of Energy, defeating emergency attempts to enjoin Kaiser Permanente’s COVID-19 vaccination policy, defeating Apple’s attempts to infringe the Match Group’s First Amendment rights, and securing a victory for BlackBerry Corp. against civil extortion and unfair competition claims.


In addition to serving as trial counsel in
Match v. Google, Mr. Reiter is currently defending Amazon against a Federal Trade Commission lawsuit accusing Amazon of using “dark patterns” to trick consumers into unknowingly enrolling in Amazon Prime and making cancellation difficult, representing Kaiser in two lawsuits in California alleging systematic underpayments of hospitals’ and physician groups’ billed charges, and representing two California agencies against claims of trade secret misappropriation and breach of contract relating to the state’s health insurance exchange system.
