Mr. Sun is a managing partner at Zhong Lun Law Firm, qualified to practice in People’s Republic of China and the New York State of the US. He graduated from New York University (LL.M), SOAS of University of London (LL.M.) and China University of Political Science and Law (LL.B.).
Mr. Sun is Representative of China to UNCITRAL Working Group II, Member of the ICC International Court of Arbitration, Member of ICC Commission on Arbitration and ADR, Board Member of Singapore International Mediation Centre (SIMC), Member of the International Advisory Board of Vienna International Arbitral Centre (VIAC), Member of the Supervisory Board of Tashkent International Arbitration Centre (TIAC),Member of the Rule Revision Committee for the Asian International Arbitration Centre (AIAC) Arbitration Rules 2021, Fellow of Charted Institute of Arbitration (FCIArb). Mr. Sun is frequently appointed as an arbitrator in international and domestic arbitration cases. He is a Panel Arbitrator of the Hong Kong International Arbitration Centre (HKIAC), Singapore International Arbitration Centre (SIAC), American Arbitration Association-International Centre for Dispute Resolution (AAA-ICDR), Asian International Arbitration Centre (AIAC), Arbitration Foundation of Southern Africa (AFSA), Tashkent International Arbitration Centre (TIAC), and Borneo International Centre for Arbitration and Mediation (BICAM). He is also Panel Arbitrator of China International Economic and Trade Arbitration Commission (CIETAC), Beijing Arbitration Commission (BAC), Shanghai Arbitration Commission (SHAC) and other leading arbitration institutions home and abroad. He is also Fellow of the International Academy of Construction Lawyers (IACL), and is on the List of Practitioner in International Arbitration of Vienna International Arbitral Centre (VIAC).

Mr. Sun has extensive experiences in arbitration, litigation and civil enforcement relating to construction and infrastructure, energy, finance, corporate equity, and real estate. He excels at sorting through intricate facts, quickly grasping key issues and assisting the clients in sketching out comprehensive and effective legal solutions. Mr. Sun has represented clients in many significant and complicated commercial dispute cases, covering jurisdictions such as the U.S., Canada, Germany, Austria, Switzerland, Bulgaria, Singapore, Hong Kong, Qatar, Saudi Arabia, Nepal, Vietnam, Iraq, Iran, Argentina, Peru, Cayman Islands, Trinidad and Tobago, Ghana, Namibia, Congo, Ethiopia, South Sudan, Zambia, etc. His most notable cases include: representing ED&F Man in applying for the recognition and enforcement of an arbitral award rendered by the Sugar Association of London, which is a landmark case in China’s arbitral judicial review regarding public policy; sitting as the emergency arbitrator in the first emergency arbitration procedure in the Chinese Mainland; serving as the presiding dispute review expert in the first case applying the Construction Project Disputes Review Rules of CIETAC; acting as counsel in the first litigation in China between the applicant for independent guarantee and the issuer over wrongful payment under independent guarantee; served as the presiding case-managing attorney for a State-Owned Enterprise (SOE) and successfully revoked an ICC arbitral award before the Singapore High Court and Singapore Court of Appeal, this was a very rare case where a Chinese enterprise successfully withdrew an arbitration award issued by an international authoritative arbitration institution in other jurisdictions.

Drawing on his practical experience, Mr. Sun is also a prolific writer and has published many books and articles in his field of expertise. His major publications include: Arbitration in China—A Practitioner’s Guide (Co-author), published by Wolters Kluwer in 2015; The Belt and Road Initiative: Legal Risks and Opportunities Facing Chinese Engineering Contractors Operating Overseas (Co-author), published by Wolters Kluwer in September 2015; United Nations Convention on International Settlement Agreements Resulting from Mediation-Legislative Background and Articles Interpretation (Author), published by Law Press in November 2018; Local Characteristics of Arbitration in China and Their Influence on Legislations, published in China Law Review (No.3(2022)) in June 2022; A Commentary on Article 16 of the UNCITRAL Expedited Arbitration Rules, published in Chinese Review of International Law (No.1 (2022)) in January 2022, etc.

For his profound professional expertise and prominent advocating performance, Mr. Sun was listed as Who’s Who Legal 2023 Arbitration “Global Leader”, 2022 Arbitration “National Leader” and 2021 Arbitration “Future Leader”; awarded “2020 ALB China Top 15 Chinese Litigators” by Asian Legal Business; awarded “Litigation Star” by Benchmark Litigation since 2019; and has been recommended by Chambers Global and the Legal 500 since 2020. Mr. Sun was nominated by GAR for “Best Development of 2019” for his role as the first emergency arbitrator in the Chinese Mainland.

  • Represented a Chinese company in an investment arbitration and a commercial arbitration against an African state: This case arose out of a construction project in Africa and was the first time that a Chinese law firm independently represented a Chinese investor in an investment arbitration. The amount in dispute was around USD 55 million. The dispute was about the government’s repudiation of the contract which is not only a contractual breach but also a breach of the bilateral investment treaty. Mr. Sun represented the Chinese investor to initiate investment arbitration and commercial arbitration at the same time so as to secure its procedural and substantive rights.
  • Represented a Chinese company in three ICC arbitrations concerning the construction of a stadium in Qatar: The disputes were about technical issues, delay and quantum among stakeholders in mainland China, Hong Kong, Qatar, India and Germany. The amount in dispute was around USD 16 million. The cases involved over 5,000 pieces of evidence and 13 witnesses (six of them were experts from different disciplines). Mr. Sun and his team spent considerable time gaining a deep understanding of the core technical dispute with the client and experts’ assistance, which helped them to put forward convincing submissions and effective cross-examinations. The cases ended up in overwhelmingly favorable awards for the client.
  • Represented a subsidiary of POWERCHINA in five ICC arbitrations concerning wind power stations in South America: The employer of the projects initiated several arbitrations, and Mr. Sun’s team represented the client to raise counterclaims for EOT and additional costs. The amount of the claim was around USD 128 million, and the amount of the counterclaim was around USD 125 million. In handling this case, Mr. Sun assisted the client in sorting out the key facts and the core points in dispute, represented the client throughout the arbitration process, and ultimately facilitated a settlement between the client and the owner. During this process, Mr. Sun's team, as the lead counsel team, worked closely with local lawyers, instructing and supervising them to provide analytical opinions on specific legal issues.
  • Represented a Chinese SOE in ICC construction arbitrations and Thailand litigations concerning a Thailand real estate project: This dispute involves the owner, contractor, subcontractors and SPV shareholders, resulting in ICC arbitration proceedings and Thailand litigation proceedings. The amount in dispute was around USD 400 million. Mr. Sun developed a comprehensive dispute resolution strategy for the client in initiating both arbitration and litigation proceedings. Mr. Sun also assisted the client in selecting and engaging Thai lawyers, instructed Thai lawyers to issue legal opinions under Thai law, participated in local Thai litigation procedures, and prepared litigation documents. The case is ongoing.
  • Represented a subsidiary of China Nonferrous in an LCIA arbitration concerning value-added tax in an African state: The dispute is about several commodity sales contracts and tax exemptions, involving local administrative and civil litigation procedures. The amount in dispute was over USD 100 million. Mr. Sun represented the client throughout the international arbitration proceeding, during which he instructed local legal and tax experts to issue reports and assisted the client in settlement negotiations with the counterparty. This case is ongoing.
  • Represented a subsidiary of CNPC in an SCAI arbitration concerning an agency agreement: Mr. Sun assisted the client in initiating an arbitration against a BVI company. The core dispute was about the interpretation and enforcement of the original award, and the case also involved the enforcement procedure in China and the annulment procedure in Switzerland. The amount in dispute was USD 40 million. Mr. Sun’s team represented the client to apply for emergency arbitrator relief and successfully obtained a favorable emergency arbitrator order, which resisted the opposing party's enforcement actions in China. This case has also been referred to as 'the first case where a Chinese court followed a foreign emergency arbitrator's order and suspended the enforcement of an arbitral award'.
